John Craxford, Gentleman of Folkestone

The Folkestone Chronicle

The Folkestone Chronicle: October 2nd 1858

John Craxford, a timber merchant and resident of Folkestone, Kent, drew up his Last Will and Testament in May 1857. There is strong circumstantial evidence (names of other family members, dates of birth, census returns) to link him to the Craxford family that were described as lath renderers, carpenters and builders, from the Clerkenwell district of London. His Will was proved in August the same year after his death and a copy is now lodged at the Public Record Office at the National Archive (1).

His estate and effects were offered for sale in an advertisement which appeared in the edition of Folkestone Chronicle of 2 Oct 1858. We are indebted to the Community Librarian at Folkestone Library for the newspaper copy and the following text:

"Folkestone, Kent - the very desirable and valuable freehold, copyhold and leasehold estates of the late John Craxford, Esq. Messrs Glasier and Son are instructed to sell by Auction at the Kings Arms Inn, in Folkestone, at 1 for 2 o'clock, in 16 lots, by direction of the executors, eight freehold houses, comprising the extensive newly-erected and substantially built residence and business premises, in Rendezvous Street, let to Mr Marchant, corn merchant. The very desirable detached cottage residence, Ivy House, Guildhall Street and six desirable and substantially built private houses, No 1, adjoining Pembroke House, 7, 8, 11, 12 and 13 Victoria Grove, Shellons Lane, also the exceedingly valuable and substantially built copyhold premises the Paris Hotel, opposite the harbour,and corner of South Street, occupying the most commanding and best situation in Folkestone, and seven leasehold houses, held direct from the Freeholder, for 90 years, at exceedingly low Ground rents, comprising the delightfully situate Marine residence immediately facing the sea, a short remove from the Lower Sandgate Road, being no. 7 Marine Parade. Two substantial and conveniently situated houses, Lower Sandgate Road, directly opposite the Pavilion, and occupied respectively by F. M. Faulkner, Esq, the British Consul; and Mr Stephen Golder. Two desirably situated semi-detached residences, Nos 7 and 8 Coleshill Terrace, Sandgate Road; the charming cliff cottage residence, Bellevue Cottage, Parade Steps, late in the occupation of the deceased, and a substantially built residence, known as Bellevue House, on the Parade; let (with the exception of two houses) at moderate rents amounting to £627 per annum
The property may be viewed by permission of the tenants, and particulars had of James Dolman esq, Solicitor, 14 Clifford's Inn, London, at thye Ship Hotel, Dover; Rose, Canterbury; Saracen's Head Inn, Ashford; Paris Hotel and King's Arms, Folkestone; of Mr Sherwood, Estate Agent, Folkestone; at Garraway's, Change Alley, Cornhill; and of the Auctioneers, 41 Charing Crosss, London"

John Craxford left his wife Harriet well provided for in his will. She survived him by five years; dying in Folkestone in 1862. Even after her death there were many assets remaining in his residual estate. A further auction was arranged in Folkestone in November 1863.

The remaining Portion of the very desirable Freehold, Copyhold, and Leasehold Estates of the late John Craxford, Esq.: - All that well-built Freehold House, being 8, Victoria-grove, in the occupation of Mr. Yates, at the annual rent of £28: all that substantial and well-built Copyhold Premises, the Paris Hotel, fronting the harbour, let on a lease to Mr. F.Denibas, which expires on the 1st September, 1865; the leasehold portion consists of all that well-built House and Premises, situate in the Lower Sandgate-road, in the occupation of Mr. S. Golder, at the nominal rent of £21 : all that first-class Marine Residence, being 7, Marine-parade, in the occupation of Mr. G. Hobday, at the low rent of £50 ; also all that substantial and well-built semi-detached Residence, being 7 Coleshill-terrace, Upper Sandgate- road, in the occupation of Captain P. Barnes, at the nominal rent of £45:also all that first-class detached residence, with stables, known as Belle Vue House, commanding most extensive views of the English Channel and French Coast, in the occupation of Mr. J. J. Wilson, at the low rent of £42 : also all that most delightful detached Villa Residence, with ornamental flower garden, known as Belle Vue Cottage, with uninterrupted scenery of the English Channel and Folkestone harbour, late in the occupation of the owner, at the estimated value of £35. Possession may be had on completion of the purchase. The properties may be viewed by permission of the tenants,and particulars and conditions of sale may be had of James Dolman, Esq. 14 Clifford’s-inn, London ; of the Estate Gazette office, 200 Fleet-street, London; and of the auctioneer, 2, Tontine-street, Folkestone.

THIS IS THE LAST WILL AND TESTAMENT
Of me John Craxford of Folkestone in the County of Kent, Gentleman. I ask
First that all my just debts funeral and testamentary expenses be paid out of
My personal estate as soon as conveniently may be after my death. And I
Give and bequeath unto my dear wife Harriott the sum of fifty pounds for her
Immediate use and direct the same to be paid to her by my Exec-
Utors hereinafter named as soon as possible after my death. And I give and
Bequeath all my furniture plate linen china prints pictures books (except books
Of account) store of wines and spirits and consumable articles and all other
Household chattels and effects in and about my dwelling house and premises
At Belle Vue Cottage, Folkestone aforesaid unto my said dear wife for her
Absolute use and benefit. I give and bequeath unto my son Edwin Frederick
The sum of five hundred pounds. I give devise and bequeath all my Freehold
Copyhold and Leasehold messuages or tenements lands and hereditaments with
The rights …… and appurtenances to the same belonging and all the
Residue and Remainder of my personal estate and effects whatsoever
And wheresoever into and to the use of my son Edwin Frederick Craxford and
My son in law James Jones their heirs executors administrators and assigns
According to the different natures and qualities thereof. Upon the trusts following
That is to say upon Trust as soon as conveniently may be after the expiration
Of twelve months from the time of my decease in the directions and of the
Absolute authority of my said Trustees or the survivors or survivors of them
Or other the Trustees or Trustee for the time being of this my Will ….
And absolutely dispose of my said Freehold Copyhold and Leasehold messuages
Lands and hereditaments either together or in parcels and either by public
Auction or private contract or partly by one mode and partly by the other and
Under such conditions of sale respecting the commencement and evidence of
Title or otherwise as the said Trustees or Trustee shall think fit with the power to
Buy in the said messuages lands and hereditaments and any part or parts
Thereof at any such auction or sale and shall afterwards resell the same in a
Manner aforesaid without being answerable for any loss or diminution in
Price upon such resale. And upon Trust as soon as conveniently may be after
The expiration of twelve months from the time of my decease to make sale and
Absolutely dispose of such parts of my residuary personal estate as shall not
Consist of money or securities for money either by public auction or by private
Contract and generally in such manner as the said Trustees or Trustee shall think
Fit and to get in coolect and receive the remaining parts of my said personal
Estate including the debt due to me from my son in law John B…. Tolputt
According to the mortgage or security intended to be given to me for the said debt
And I declare that it shall be lawful for my Trustees and Executors in the
Execution of their trust to allow such time and accept such security seal or
Personal for the payment of and to accept such composition for any debt or sum

Of money owing to me from any person or persons whomsoever they or he

Whom she may afterwards marry the receipt or receipts in writing of my
Said wife notwithstanding coverture to be a good and sufficient discharge or
Good and sufficient discharges for the said dividends interest and annual
Proceeds or so much thereof as in such receipt or receipts shall be expressed to
Be received. And I further declare that after the decease of my said wife the
Trustees or Trustee for the time being of this my Will shall stand possessed of
The Stocks Funds and Securities directed to be purchased as aforesaid. Upon the same
Trusts as those hereinafter declared concerning the balance of the monies to arise
From the sale conversion and getting in of my Real and Residuary Personal
Estate after making the investment aforesaid And I also declare that my said
Trustees or Trustee shall stand possessed of the balance of the monies to arise from
The said sale conversion and getting in of my said Real and Residuary Perso-
Nal Estate after making the investment aforesaid upon Trust for my six chil-
Dren Edwin Frederick, Emma Ann, Harriott Ann, Jane, and John in equal
Shares as tenants in common but as to the shares of my daughters and the
Share of my said son John subject to the declarations hereinafter contained
And I declare that the Trustees or Trustee for the time being of this my Will
Shall lay out and invest the share of each one of my daughters in the monies
And effects aforesaid in the purchase in the names or name of the said Trustees or Trustee of Capital
Stock in some or one of the Public or Parliamentary
Stocks Funds or other Government Securities or upon Real Security at inter-
Est of due in England or Wales with full power from time to time as often
As occasion shall require with the consent in writing of such my Daughter
During her life and after her decease of the proper authority of the said Trustees
Or Trustee to alter vary and change those Stocks Funds and Securities in which
Such investment shall be made or any which may be substituted therefore
Into or for another or others of the nature aforesaid. And I declare that the
Said Trustees or Trustee shall receive and take the dividends interest and actual
Proceeds of the said Stocks Funds and Securities as and when the same shall
shall become due and payable and pay the same unto said daughter for her
Natural life for her sole and separate use and benefit independent of the debts
Control or engagement Of any husband (present or future) of said daughter
The receipt or receipts in writing of such daughter to be notwithstanding
Coverture or good and sufficient discharge or good and sufficient discharge for
Said dividends interest and annual proceeds or ……………….

Immediately after the decease of said daughter the said Trustees or Trustee
Shall stand possessed of the said Trust Monies Stocks Funds and Securities in
Trust for such children of such daughter or being a male which shall
Attain the age of twenty one years or being a female or females shall attain

The age of twenty one years or be married which event shall first happen in
Equal shares as tenants in common if more than one Provided always and
I declare that if at the decease of such daughter any of her children shall not
Have attained a vested interest in the said trust monies stocks funds and securities
The said Trustees or Trustee shall or may apply all or any part of the dividends
Interest and annual proceeds of the presumptive or contingent share or shares
Of such Child or Children in for or towards the maintenance and education of
Such child or children or at the option of said Trustees or Trustee pay the said
Dividends interest and annual proceeds to the surviving husband (if any) of a
Such daughter for the purpose of being so applied but without any obligation
On the part of the said Trustees or Trustee to see to the application thereof And
I further declare that it shall be lawful for the said Trustees or Trustee with the
Consent in writing of the said daughter during her life and after her
Decease of the proper authority of the said Trustees or Trustee to apply any part
Of the capital of the vested or contingent share or shares of any child or
Children of such daughter in or for his her or their advancement or prefer-
Ment in the world in such manner as to the said Trustees or Trustee shall
Seem fit And I further declare that in case there shall be no child of such
Daughter who being a male shall attain the age of twenty one years or being
A female shall attain that age or be married then the said stocks funds and
securities invested for the benefit of such daughter or so much thereof as shall
remain after the exercise of the process aforesaid shall be In Trust for such person
or persons as would by virtue of the Statutes for the Distribution of the Estates of
Intestates have been entitled thereto in case the said daughter shall die
Unmarried and intestate and in such shares as directed by the said Statutes
And I declare that the Trustees or Trustee for the time being of this my Will
Shall lay out and invest the share of my said son John in the monies and
Effects aforesaid in the purchase in the name or names of the said Trustees or
Trustee in some or one of the Public or Parliamentary Stocks Funds or other
Government Security or upon Seal Security at interest of and in England or
Wales with full power from time to time as often as occasion shall require
Alter vary and change the Stocks Funds and Securities in which such investment
Shall be made or any which may be substituted therefore into or for another
Or others of the nature aforesaid And I declare that the said Trustees or Trustee
Shall exercise and take the dividends interest and annual proceeds of the said Stocks
Funds and Securities as and when the same shall become due and payable and
Thereout pay unto my said son John the sum of one pound weekly and every
Week during the term of his natural life with full power for my said Trustees
Or Trustee to increase any such weekly payments in case and to the extent that
Such last mentioned dividends interest and annu7al proceeds will allow And I
Declare that it shall be lawful for the said Trustees or Trustee for the time being at
Their or his sole discretion from time to time or at any time or times after the
Making of such investment for the benefit of my said son John as aforesaid
Sell and dispose of all or any part of the Stocks Funds and Securities in which
My said John and thereafter to pay him the dividends upon so …. And
Such parts of the said Stocks Funds and Securities as shall remain after such
Sale or sales or part thereof in such weekly sums as the amount of such last
Mentioned dividends will from time to time allow of provided also and it is my
Will that in case all or any of therein the said Edwin Frederick Craxford and
James Jones or any Trustee or Trustees to be appointed under this present pro-
Vision in their or either of their place shall depart this life or be desirous of being
Discharged of and from the aforementioned trusts or shall go to reside beyond the seas or
Shall ….. or refuse or become incapable to act in the said trusts before the
Same shall be fully executed and performed then and in that case and when and
As often as the same shall happen it shall and may be lawful for my said wife
During her life and after her decease for the acting Trustee or Trustees for the first

Being or the surviving or last acting Trustee of this my Will or his executors or
Administrators to nominate any fit person or persons to supply the place of the
Trustee or Trustees respectively so dying desiring to be discharged or going to reside
Beyond the seas or refusing or neglecting or becoming incapable to act as aforesaid
And that immediately after every such appointment the trust estates monies and
Effects then subject to the trusts of this my Will shall be conveyed assigned and
Transferred so and in such manner that the same may rest in ... other Trus
Tee or Trustees jointly with the surviving or continuing trustee or solely as the
Same may require and in his her or their executors administrators and assigns.
Upon the trusts in this my Will expressed and declared of and concerning the
Same or such of them as shall be then subsisting or capable of taking effect and
That every such new Trustee shall have and may exercise the same powers and
Privileges and authorities as if he had been appointed a Trustee of this my Will
And as if his name had been inserted herein instead of the name of the Trustee
Hereby appointed or in or to whose place such new Trustee shall come or suc-
Ceed provided always and thereby declare that every receipt which shall be
Given by the Trustee or Trustees for the time being acting in the execution of the
Afforesaid trusts for any money to be received by them or him by virtue of this my
Will shall be a legal and conclusive discharge to the person or persons paying
The same and fully and for ever release and exonerate such person or persons
From all obligation of seeing to the application thereof and from all lieu and
Liability by reason of the misapplication or nonapplication thereof or of any
Part thereof. And I appoint the said Edwin Frederick Craxford and James Jones
Executors of this my Will provided also and I do hereby further declare my
Will to be that they my said Trustees and Executors or any of them their or
Any of their heirs executors or administrators shall not be charged or chargeable
With or accountable for any more of the aforesaid trust estate monies and promises
Than they ……. shall actually receive or shall come to their respective hands
By virtue of this my Will nor with or for any loss which shall happen with
Out their respective wilful default nor any one or more of them for the other
Or others of them nor for the arts deeds receipts disbursements or defaults of the
Other or others of them by each of them only for his own arts deeds scripts or
Disbursements and wilful defaults. And also that it shall and may be lawful
For them my said Trustees and Executors and their respective heirs executors
And Administrators in the first place by and out of the aforesaid trust estate
Monies promises to deduct and reimburse themselves respectively and to
Pay or allow each other all such loss costs charges and expenses as they shall
Respectively sustain expend or be put unto by reason of the several trusts hereby

Such Real Estates as are vested in me as sole mortgagee in fee or sole Trustee in
Fee unto and to the use of the said Edwin Frederick Craxford and James Jones

Made for my said wife shall be taken by her in full or satisfaction of

Proved at London 12th August 1857 before the Judge by the Oaths of Edwin
Frederick Craxford the Son and James Copeland Jones (in the Will written as
James Jones) the Executors to whom Admin was granted they having been
First sworn to wit and said Edwin Frederick Craxford by Commission and the said
James Copeland Jones before the Worshipful Frederick Thomas Pratt Doctor of
Laws and Surrogate duly to administer.
